Terms of Use

Welcome to Jojna App where dog owners and staff at dog daycares can communicate with each other and share information about the dogs.

1. General information

1.1. These Terms of Use and Privacy Policy, including instructions referred to herein (collectively, the ”Agreement”) constitute an agreement between Pappa AB (“Pappa”) and the User (the ”User”) of the Service Jojna App (“the Service”) and govern the terms of the User’s access to and use of the Service.

1.2 By accessing the Service and signing up, the User declares that he has read and approved the Agreement and accepts that his rights and obligations with regard to the Service are regulated by the Agreement and thereby undertakes to comply with the Agreement.

1.3 By accepting the Agreement, the User confirms that he is at least 18 years old or otherwise has the guardian’s consent to enter into the Agreement and that the User represents himself and does not represent anyone else in the contractual relationship.

2. Use of Service

2.1 The user’s access to and use of the service presupposes that the user’s Dog Daycare has entered into a valid agreement with Pappa at the time on the use of the service. Pappa does not charge the User any fee for his use of the Service. The User is responsible for any possible costs for necessary equipment and connection.

2.2. When registering for the Service, the User must enter correct and complete information. As long as the User is connected to the Service, he is also obliged to update the information if it changes. If the User does not provide Pappa with accurate, complete and up-to-date information, Pappa’s ability to provide the Service or otherwise fulfill the Agreement may be limited. The User is aware that Pappa may refuse the User access to the Service and / or terminate the Agreement in accordance with clause 7.2, if the User does not provide correct, complete and updated information.

2.3 The User’s use of the Service includes that text, photos, videos, documents and other content may be uploaded, published, shared and saved in the Service by the User. The User may also be given access to content published by other Users.

2.4 The user may not use the service in an illegal manner and must comply with all applicable laws, rules and guidelines and copyright law. The user may not publish content that is discriminatory, illegal, offensive or that infringes on the rights of others. The User may also not use the Service in a way that involves slander, bullying, persecution or violation of anyone else.

2.5 The User is responsible for ensuring that his access to the Service is not spread to or used by any unauthorized person.

2.6 Pappa reserves the right to update, change, temporarily limit or terminate the Service or your access to the Service at any time without liability or liability.

3. User’s license

3.1 Pappa grants the User a non-exclusive, non-transferable, free license to the Service. All rights not expressly granted to you in this Agreement, in its current or additional wording, are retained by Pappa and the material contained in the Service may be protected by intellectual property rights and may belong to third parties. This Agreement does not give the User any right to use such material.

3.2 The User is not entitled to (i) transfer, license, copy, publish or distribute the Service; (ii) allow third parties to use the Service; (iii) transfer rights acquired by the User under the Agreement; or (iv) circumvent any of the technical limitations of the Service, or decompile or otherwise redesign the Service, unless otherwise provided by mandatory law.

3.3 The user is responsible for and guarantees that:
(i) Information and materials that the User uploads or uploads to the Service do not infringe on the rights of third parties or otherwise violate the law or the rights of third parties;
(ii) The User has the right to have information and materials at its disposal and has obtained the necessary consents to the extent required to use the Service and for Pappa to have the right to provide the User the Service.

4. Limitation of liability

4.1 The service is normally provided without interruption. However, Pappa does not guarantee that the Service is free from errors, interruptions or ”bugs” during this time.

4.2 From time to time, Pappa may perform maintenance on and upgrades to the Service, which may result in interruptions, delays or errors in this. Pappa strives to notify planned maintenance in advance, but can not guarantee that notice of this will always be provided.

4.3 The User’s access to the Service is dependent on services from third parties (such as mobile telephony services). Pappa has no responsibility for the performance of such services.

4.4 Unless otherwise stated in section 3.2, Pappa is not under any circumstances liable for indirect damage, loss of data or other losses in connection with the use of or non-use of the Service.

4.5 Pappa is not liable in any case for damages or losses incurred by the User due to Pappa’s obligation to comply with applicable laws and regulations, act or omission of authority, war, accident, natural disaster, strike, blockade, or other similar circumstance, regardless of whether Pappa is behind such a circumstance or is subject to it.

5. Personal data processing

5.1 In order for Pappa to be able to provide the Service to the User, Pappa needs to collect and process certain personal information about the User, the User’s dog and relatives. It is important that the User reads through, understands and accepts how personal data is processed in the Service. If the User does not accept that personal data is processed in the manner described here or after a period of use of the Service, wants personal data to be deleted, the User must unsubscribe from the Service.

5.2 The collection and processing of personal data in the Service is that User can register and be able to take part in and use the Service. This personal data can be used for contact and sending information about offers and the Service.

5.3 The User’s Dog Daycare is responsible for the User’s and Users ’dog and relatives’ personal data when these are collected by the Dog Daycare or when the User submits the information through the Service to the Dog Daycare. As the person responsible for personal data, the Dog daycare is responsible for ensuring that the User’s and User’s dog(s) and relatives’ personal integrity is protected in accordance with the Data Protection Ordinance and other applicable laws and regulations from time to time. It follows that the Dog daycare in its capacity as personal data controller is obliged to inform the User that information about the User and User’s dog and relatives is collected, what personal data is stored, the purpose of the storage, and what the data is used for.

5.4 Pappa is the personal data assistant for the Dog daycare. As a personal data assistant, Pappa may only process the personal data covered by the personal data assistant agreement between Pappa and the Dog daycare and in accordance with the instructions regarding the handling of personal data that the Dog daycare provides to Pappa. The personal data processed or stored in connection with registration and use of the Service may be name, telephone number, e-mail address, postal address, photos, video, date of birth, presence and absence as well as other personal data provided through the Service regarding the User and User’s dog and relatives.

5.5 Pappa must, at the request of the Dog daycare or the User, provide documentation of which personal data is processed. Personal information about the User and the User’s dog and relatives shall be changed or deleted by the User, but the User has the right to request deletion of the information or correction of incorrect information directly from Pappa. If the User wishes to receive information about the personal data processed by Pappa on behalf of the Dog daycare or request correction of information, such a request must be made in writing to the Dog daycare or directly to Pappa (via e-mail to support@jojna.com) and must contain information about your name, social security number, address and telephone number.

5.6 Pappa has given the Dog daycare sufficient guarantees to implement appropriate technical and organizational measures in such a way that the processing of personal data meets the requirements in accordance with the Data Protection Ordinance or other applicable regulations and to ensure that the User and User’s dog and relatives’ rights are protected.

5.7 Pappa has the right to use subcontractors for the fulfillment of his obligations under this Agreement. For such subcontractors, Pappa shall ensure that the agreements with them contain the necessary regulations with regard in particular to the security and processing of personal data. Please note that special provisions in any personal data assistant agreement between the Dog daycare and Pappa may take precedence over or supplement this point.

5.8 When the User terminates the use of the Service, the User shall delete his and the User’s dog’s personal data (profile) in the Service. If the User has not used the Service for a continuous period exceeding 6 months, the User’s and User’s dog’s personal data (profile) may be deleted by Pappa (unless storage of the personal data is required by law or subcontractor has a legal basis to process relevant personal data).

6. Privacy

6.1 Pappa observes confidentiality regarding the User’s information in the Service and for communication that takes place via the Service. Pappa undertakes not to prepare unauthorized access to or disclose the User’s and Users ’dog and relatives’ information to unauthorized persons. However, Pappa reserves the right to disclose information that Pappa is required to disclose or otherwise disclose by law.

7. Contract period and termination

7.1 The agreement is valid until further notice. The User has the right to terminate his account with the Service at any time and thereby terminate the Agreement with immediate effect. Pappa has the right to terminate the Agreement at any time and / or stop providing the Service.

7.2 Pappa has the right to block the User’s account, deny him access to the Service and / or terminate the Agreement with immediate effect, if
(i) it comes to Pappa’s knowledge or Pappa otherwise has reasonable cause to assume that the User is using or will use the Service in violation of the Agreement or otherwise against applicable law or regulation;
(ii) information has emerged regarding technical or administrative procedures for information security that there is reasonable cause to fear that the User’s account will be misused;
(iii) there is otherwise reasonable cause to believe that the User’s account has been misused or will be misused;
(iv) The user withdraws his consent to the processing of personal data as described in paragraph 5, or
(v) if the User does not provide accurate, complete and up-to-date information to the account.

8. Changes

8.1 Pappa has the right to make changes to the Agreement from time to time here. Pappa strives to inform the User about applied changes in the Agreement. The User’s approval or continued use of the Service after such publication herein is deemed to constitute his consent to be bound by the Agreement in its amended wording.

9. Dispute

9.1 These Terms of Use shall be governed by and construed in accordance with the laws of Sweden without regard to the principles of conflict of law therin.
